Answer a few quick questions and our Provisional Patent Readiness Quiz will flag potential timing and readiness gaps worth sorting out first.
It’s free, private, and takes a couple of minutes — though it’s general information only, not a substitute for advice from an IP Guardian attorney.
Ready to talk filing strategy?
Patent readiness comes down to specifics — exact dates, who actually owns the invention, and how completely it’s described. A quiz can point you in the right direction; only an attorney reviewing your actual invention can tell you whether you’re ready to file and how to protect it properly. Provisional Patent Readiness Quiz
Question 1
Thinking about filing a provisional patent application? Answer a few quick questions about your invention and this tool will flag potential readiness gaps and timing issues that may be worth sorting out before you file.
Your situation
Where are you looking to protect this invention?
This just helps us frame your results — it doesn't change which pathways get flagged.
Question 1 of 8
Have you already shown, sold, demonstrated, published, or otherwise publicly disclosed this invention anywhere in the world?
This includes trade shows, pitches sent outside a confidentiality agreement, product launches, social media posts, academic papers, or crowdfunding pages.
Question 2 of 8
Do you have an upcoming public disclosure planned — a launch, investor pitch, trade show, publication, or crowdfunding campaign — in the next few weeks?
Question 3 of 8
Could someone skilled in your field build or carry out the invention just from a written description and drawings, without you filling in gaps verbally?
A provisional doesn't need to be perfect, but a more complete description can support a stronger priority date.
Question 4 of 8
Have you searched to see whether a similar invention is already patented or publicly known?
Question 5 of 8
Is more than one person involved in developing this invention — a co-founder, employee, contractor, or research collaborator?
Question 6 of 8
Was this invention developed using your employer's, a university's, or a client's time, resources, or funding?
Question 7 of 8
Do you have a genuine intention to commercialise this invention — selling, manufacturing, or licensing it — rather than only protecting an idea?
Question 8 of 8
Have you already filed a patent application — provisional or complete — for this invention, in Australia or elsewhere?

FAQs
Does this quiz tell me if my invention is patentable?
No. The Provisional Patent Readiness Quiz gives general information only, based on your answers to a short questionnaire. It doesn’t assess novelty, inventiveness, or patentability, and shouldn’t be relied on or acted upon as advice. For an assessment of your specific invention, please contact IP Guardian directly.
What if I've already publicly disclosed my invention?
Timing matters. Some disclosures may still be protected under a limited grace period in Australia, but this depends on exactly when, where and how it happened, and the rules are different — often stricter — overseas. If this applies to you, it’s worth contacting an attorney promptly rather than waiting.
Is my information kept private?
Yes. Everything happens in your browser — your answers aren’t recorded, sent to IP Guardian, or stored anywhere unless you choose to contact us afterwards. You can use the tool anonymously.
What should I do after I get my results?
Whether your results look ready or flag a few things, the next step is a filing strategy conversation with one of our patent attorneys. Bring along any documentation you have — sketches, prototypes, dates of any disclosures, and details of who was involved in developing the invention.
